My name is Stacy S, I am from Appleton WI. My 18-year-old daughter Amber S came to LA on July 11th, 2008 for a photo shoot with a Mr. Amir Daniel Nourmand whom lives and works out of his business studio at 2220 Ave of the Stars #1902W and came home a different person. I read your statement that I copied
and pasted above from your website and I am writing to you as a stranger with an obligation to society. I hope you take my daughters story, listen to what I have
to say and listen to your heart and help make changes to protect LA and all walks of life from this happening to someone else. Here is my story.......

My daughter Amber S, is a beautiful 18 year old girl whom wrestled on the all boys team for her high school all 4 years on varsity at 112. She made history
at her school for being the first girl to wrestle varsity and win in her conference. She was on the cover of WI sports prep Illustrated and had an article done on her
titled "Girl's on the Mat - Girls in a boys World." She is a talented singer and took first in state for her solo earning the exemplary soloist award. She worked with the mentally challenged her senior year of high school, making a difference to many people who are less fortunate. She works out at the local gym 5 days a week and has been a positive role
model to many girls. She started modeling on the side and it became a passion for her. Here is a girl who can go out and wrestle walk off the mat bleeding and bruised but yet get all dressed up and take beautiful pictures. She is truly loved by so many and very well known and respected in her community.
Daniel Nourmand took that girl my daughter Amber S who I was talking about and has changed everything about her. After he confessed to raping her while she was asleep on his bed after a couple drinks he had given her, she cries every night, still gets sick to her stomach and even tho she is seeing a rape counselor, we still might have to hospitalize her due to all the anger that is built up inside of her due to him raping her. She hits herself, runs off and goes though times of uncontrollable crying. She cannot concentrate, has put off school, she cannot sleep and has become so depressed she stares into space. There are good days, don’t get me wrong but those are very few lately. The only good thing is that when she has to be strong, like when she had to talk to him to get him to admit his guilt and tape those conversations for the LAPD for evidence, she stayed strong so at least that isn’t lost, but as soon as she was done talking to him, that strength crumbled. My daughter doesn’t remember all of that night, due to what he may have slipped her in her drinks, just bits and pieces. Daniel dropped her off on July 1 1th, 2008 where she was staying and her friend called the police the minute she walked in the door and the police wrote a report and took her to UCLA medical rape treatment Center. She was treated for sexually transmitted diseases from her doctor here in Wisconsin, because the UCLA rape treatment Center never treated her for any the night of July 11th, in fact when we called and had them discuss with our doctor how they treated her and what they all gave her that night, UCLA had no record of what they did to her, they said they sent it with the police and now she has to get an Aid’s test done in six weeks, because even tho Daniel said he penetrated her with his penis for a couple minutes if that, she isn’t sure how long he really had sex with her, due to being in and out of consciousness while at his studio.
Detective Roditis of the West Los Angeles Police Department (#213-473-0436) is presenting the case before the district attorney this week but we still have no idea where her rape kit is or her toxicology report is. That could be a huge factor in helping bring our case against Amir Daniel Nourmand to justice and saving other girls out there from having him do the same thing to them that he did to my daughter. A backlog in the testing of rape kits in Los Angeles means that many crime victims still wait for answers.

I spent a recent morning at the Rape Treatment Center at Santa Monica-UCLA Medical Center, where women (and men and children) get emergency medical care and counseling immediately after they have been raped. I was researching how the center's nurse practitioners collect evidence for a "rape kit."

According to the Justice Department's most recent National Crime Victimization Survey, only about 40% of sexual assaults are reported to police, though other nongovernmental studies indicate even lower rates of 10% to 20%. But among those who do report a rape, most are taken to a hospital to have a rape kit created. In this age of "CSI" and other forensic science TV series, rape victims believe that DNA and other evidence in their rape kits will help police and prosecutors find and punish their assailants. If only that were more true.


The process -- which can last more than four hours -- begins in a private interview room, separate from the hospital emergency room, where a counselor asks in detail what happened during the rape. The counselor is there throughout the subsequent examination.

If I were a rape victim, I would next be led into the exam room and asked to undress while standing on a large sheet of butcher paper so that anything that falls from my clothing or body that may provide links to a perpetrator or a crime scene (hairs and carpet or clothing fibers) can be carefully collected and placed in the rape kit.

I would be examined on a gynecological table with stirrups. My body would be scanned with an ultraviolet light to find otherwise undetectable semen or saliva that might contain the assailant's DNA.

(The nurse walking me through these steps tells me about a woman awakened in the middle of the night by an intruder. He sexually assaulted her for hours and licked and kissed her neck. Then he shoved her in the bathroom and told her to take a shower and douche. While she stood in the shower, she protected her neck so that evidence wasn't washed away.)

The nurse would check my entire body, swabbing every part the assailant touched. Then she would photograph physical injuries, which might include bruises, bite marks or burst blood vessels in the whites of my eyes from strangulation. A magnifying camera -- designed to be as noninvasive as possible -- would then record tears or other injuries to my mouth, vagina or anus.

With incredible care, the nurse would then collect fingernail scrapings, pubic-hair combings and urine and blood samples, placing each in separate envelopes. The swabs also would be labeled and sealed in containers with evidence tape. All this goes into a large white envelope -- the rape kit.

If I were a rape victim, the police officer on duty at the center might drive me home with the rape kit in the patrol car. I might imagine that the police were taking it directly to the crime lab to test the samples for DNA that could identify my assailant or provide evidence against an already identified suspect. In 2004, Californians voted overwhelmingly for Proposition 69, which expanded the number and types of offenders whose DNA goes into local, state and national databanks.

But the truth is, after all of that careful and meticulous collection, the rape kit may never be opened, much less tested.

The National Institute of Justice estimates that at least 400,000 rape kits are sitting untested in police stations and crime labs across the country. In the city of Los Angeles alone, more than 7,000 sit in refrigerated storage in a city warehouse facility and a trailer behind police headquarters. The Los Angeles County Sheriff's Department likely has its own backlog, but the sheriff has never disclosed its size.

Law enforcement officials blame a lack of resources -- for starters, they need more crime lab staff. But it's hard not to surmise that the problem is, in reality, a matter of priorities. Among L.A. City Council members, only Jack Weiss has insisted on budget increases to address the rape kit backlog. This year, Mayor Antonio Villaraigosa rejected the LAPD's funding request to hire more crime lab staff.

If I were a rape victim, I might never know whether my rape kit was opened. I might assume that silence from the police meant that the crime lab just didn't find any DNA, or none that identified my assailant. Although not every tested rape kit yields a database match, when New York City processed all its backlogged rape kits in 2003, the effort led to about 2,000 hits.

The morning I visited the Rape Treatment Center, three women came to report that they had been raped and to get care. They consented to the extensive, lengthy exam because they had entered into a pact with the police: We will submit to this collection of evidence, and you will submit our rape kits for testing.

I wish I hadn't known the likely fate of their rape kits -- to sit on a shelf, frozen and unexamined. If I were a rape victim, that news would be devastating.

Under California Penal Code 261-269:
(a) Rape is an act of sexual intercourse accomplished with a
person not the spouse of the perpetrator, under any of the following
circumstances:

(3) Where a person is prevented from resisting by any intoxicating
or anesthetic substance, or any controlled substance, and this
condition was known, or reasonably should have been known by the
accused.
(4) Where a person is at the time unconscious of the nature of the
act, and this is known to the accused. As used in this paragraph,
"unconscious of the nature of the act" means incapable of resisting
because the victim meets one of the following conditions:
(A) Was unconscious or asleep.
(B) Was not aware, knowing, perceiving, or cognizant that the act
occurred.
(C) Was not aware, knowing, perceiving, or cognizant of the
essential characteristics of the act due to the perpetrator's fraud
in fact.
(D) Was not aware, knowing, perceiving, or cognizant of the essential characteristics of the act due to the perpetrator’s fraudulent representation
that the sexual penetration served a professional purpose when it served no profession
al purpose.

Under California Penal Code 680 DNA bill of rights:
(3) Law enforcement agencies have an obligation to victims of sexual assaults in the proper handling, retention and timely DNA testing of rape kit evidence
or other crime scene evidence and to be responsive to victims concerning the developments of forensic testing and the investigation of their cases.
(4) The growth of the Department of Justice's Cal-DNA databank and the national databank through the Combined DNA Index System (CODIS) makes it
possible for many sexual assault perpetrators to be identified after their first offense, provided that rape kit evidence is analyzed in a timely manner.
My questions are:
1-Why did UCLA Rape Treatment Center not treat her for sexually transmitted diseases, take blood for evidence or give my daughter the morning after pill?
If you are drugged many rape victims do not remember all that happened that night, and many do not know they were drugged.
ALL persons walking into that clinic for rape should have a standardized procedure they go through in case of a drug is slipped into their drink.
2-Where is my daughter’s rape test kit and urine sample and why is it not tested before it goes to the DA? This happened 3 weeks ago, and every time we call
the results are not in but yet when we call the Toxicology Center #323-415-8870 (Christina) she hasn’t seen it yet. And when we call the crime lab #323-415-8100 to
check on the results of her rape kit they cant seem to find anything there either. When we call Detective Roditis she just informs my daughter the test results are not in yet.
We don’t even have a DR number yet! If LA cannot afford the testing for the DNA, I will pay for it to be done.

My daughter followed all the rules, she went over and beyond what a victim should go through to try and take this guy off the streets of LA and make it a safer place.

She was one of the 10% who reported it right away, went through the lengthy procedure at the UCLA Rape treatment center and went out of her way to tape
conversations with the man who raped her to make sure there was enough evidence to get him off the streets, as asked to do so by the LA police force.
This is my story, from a mother and father who loves their daughter and why we together as a family want justice; please help me make a difference and help not only
my daughter but other peoples daughters out there. Help us find her rape test kit, clothes and urine that was taken on July 11 –12th, 2008 and have it tested so she
can start moving forward with her life.

Dear Mrs. Schroeder,

I have tried to call you back twice today but your phone has been busy. In regards to your daughter's case, I have decided to reject it based on insufficient evidence. The D.A.'s office has very strict filing guidelines. One of those guidelines is that the filing deputy, in this case me, be sure that the evidence is of such convincing force that it would warrant conviction of the crimes charged by a reasonable and objective fact finder after hearing all the evidence available and after considering the most plausible, reasonably foreseeable defenses inherent in the prosecution's evidence. This case does not meet the criteria. I am sorry, but here are the facts that are before me:

Your 18 year old daughter travelled to Los Angeles with a friend to be photographed by the suspect. She went alone to the suspect's house for the photo shoot. She gave him a selection of outfits to pick from and he chose a pink bra and thong. She put that outfit on. He offered her two drinks which she chose to accept. He offered to rub lotion and oil on her body which she allowed him to do. She then agreed to take her bra off and let him photograph her in just a thong and boots. Your daughter is alleging that the suspect then took advantage of her when she passed out. The problem is that her blood alcohol level was only a .08 approximately 2.5 hours after the crime occurred. Therefore, we can assume that her BAC was approximately .12 to .14 at the time of the crime. She would not be passed out at that BAC. Trust me. We try these types of cases all the time. Furthermore, she told the Sexual Assault Exam Nurse that she remembered everything that he had done to her, yet she never mentioned that the suspect had sex with her. It wasn't until the pretext phone call that she is now alleging that he put his penis inside of her. Which gets to the next issue, the pretext phone call. Your daughter was sitting on another guy's lap while she made the pretext call. That does not look good when she is making a pretext call to a suspect that she is alleging raped her. Last, the suspect has repeatedly stated that he thought it was all consensual and thought she was his girlfriend. He has stated that when she asked him to stop, he stopped.

This case, if filed, would never even make it past a Preliminary Hearing. Unfortunately, I know this is not the decision you wanted me to make. However, as an officer of the court, I have a duty to both ethically and to my office and I cannot file this case based on this evidence. I am truly sorry about what your family and your daughter are going through. I hope you understand how and why this decision was made.

This is Amber. you make this sound like its all my fault and i really dont apprciate that because it was not at all. i WAS passed out and i didnt recall him putting his penis in me because i thought i remembered everything until on the phone, he told me i fell asleep and i didnt remember falling asleep. when i read this, i was disgusted. you have NO IDEA what i have been going through and this did not make it any better. if it was consensual, i would not of said anything, or cried or went to therepy. and when i took off my bra, i was almost completly out of it. "She would not be passed out at that BAC. Trust me." Were you there? who are you to tell my mother that i wasnt passed out? i got taken advantage of! do you really think i would do stuff with a 40 something year old guy when i have a boyfriend that i deeply care about at home? and he thought i was his girlfriend? we met one time. thats a little creepy if you ask me. Please get your story straight. And he didnt stop when i asked him to so belive what you want. This letter really made me upset and i dont feel like dealing with this anymore anyways. p.s. i did my duty. i went right to the police. he got away with this once, and he will do it again. so, if anymore girls get raped, i put the blame on the DA. i have a taped conversation with a model that went through similar if not the same thing i did. so, goodluck to you, because im sure you will be dealing with him again. that is if the girls are strong enough to deal with going to the police. and also, i had to talk to Daniel after he raped me for about 2 weeks. Do you think i really wanted to talk to the guy? EVERYTIME after i talked to him, i bawled my eyes out. and everyday i deal with this. Everyday. and now knowing that the case id being rejected and that he is getting away with this....will really make this hard for me.

Now I have a videotape of the suspect admitting that he had sex with my daughter while she was out of it.... which I can forward to you. This guy has already done this once he will do it again, please listen to the tape and you tell me if this story should be brought to the public’s attention! Did my daughter get justice? Did your community get justice?

The questions are:
Why was he not arrested the night she called the police right after it happened? Valuable evidence could have been collected!!!!

Why didnt UCLA Rape Treatment Center not draw her blood for drug evidence, if you are drugged you dont know what is happening to you. This should be done at every visit. Please look up the date rape drug

Why did the police wait so long to test her urine sample and we still do not have the rape test kit results back. Did they even test it?

How could the police department make my daughter talk to the guy who raped her and we have the sheet that Det Roditis sent to my daughter telling her what to say to this guy to get him to admit things and she had to tape every conversation with him. How could they make her relive this and then do nothing.

There are other models we spoke with that he had some of the same experiences with this man.

Please help us, he is still taking pictures of girls!!!

This kind of injustice is happening in every corner from this world:cantlook:. Here in Romania is full with this kind of dirty things. Alot of women are raped, and alots of incests are happening. Few weeks ago, a 14th year girl was raped by her uncle and she became pregnant, and she stop her pregnancie on a clinique in U.K. And her uncle is free in this days.
